Terms and Conditions

Payment and signing of the Waiver and Release of Liability and acknowledgement of these Terms and Conditions are required prior to pick-up of rental equipment.

A valid government-issued identification card is required to rent watercraft.

CUSTOMERS MUST CONTACT BEARFOOT KAYAK LLC AT (252) 378-2113 IF INTENDING TO COMPLETE THE RENTAL EARLY. CALL WHEN RETURNING TO THE START POINT OR WHEN FINISHED. REMAIN WITH THE EQUIPMENT UNTIL BEARFOOT KAYAK LLC ARRIVES.

All customers must be at least 65 pounds to use any equipment without a guide.

Maximum weight for a single kayak is 250 pounds; maximum weight for the tandem kayak is 500 pounds combined.

Customers must be 10 years old to use single-person watercraft and must be accompanied on the water by an adult.

Customers must be 16 years old to paddle alone with parent or legal guardian consent, signature, and driver's license number on the Waiver and Release of Liability.

Children must be 8 years old to accompany an adult in the tandem kayak without a guide.

Children must be 5 years old or older to accompany an adult in the tandem kayak with the River Guide present.

Boats are to be used only by the original customer(s). Additional customers wishing to use the same watercraft must sign the

Waiver and Release of Liability and acknowledge these Terms and Conditions.

For overnight or multi-day rentals, the renter is responsible for the equipment from the time it is issued until it has been returned to and accepted by BearFoot Kayak LLC. Equipment must be stored in a secure location and may not be loaned, sub-rented, or left unattended in public areas or unsecured vehicles. Theft, loss, or damage must be reported to BearFoot Kayak LLC immediately.

Never leave rental equipment unattended.

Life jackets should remain properly worn and securely fastened while on the water. North Carolina law requires children under 13 years of age to wear a U.S. Coast Guard-approved life jacket while underway on a recreational vessel unless an exception provided by law applies. All participants are strongly encouraged to wear a life jacket at all times.

It is against federal law to chase, harass, or feed wildlife. For your safety and to remain in compliance with the law, leave wildlife alone and maintain a safe distance.

It is against federal law to interfere with the operation of other vessels. Remain to the right side of the waterway whenever practical and safe to allow adequate room for other watercraft.

No alcohol, illegal drugs, marijuana, or medications or other substances that impair safe operation may be used before or during any rental. Customers suspected of impairment will be refused service or required to end their rental without refund.

No hunting or fishing from rented watercraft.

Property bordering the river may be privately owned. Unless it is an emergency, do not leave your watercraft or remain on private property without permission.

By renting equipment, the customer understands the variable and sometimes severe nature of weather. BearFoot Kayak LLC may delay, shorten, or cancel rentals if unsafe conditions are expected. Customers assume the inherent risks of changing weather conditions that occur after the rental has begun.

By renting equipment, the customer understands that wildlife, submerged objects, currents, tides, changing water levels, and other natural hazards are present. Customers assume the inherent risks associated with outdoor recreation.

BearFoot Kayak LLC is not responsible for loss of or damage to the customer's personal property during the rental.
Additional Fees
-
Late Return: A fifteen (15) minute grace period is allowed. After that, customers will be charged $15 per boat for each additional hour or portion thereof. For overnight or multi-day rentals, failure to return equipment by the agreed return date may result in an additional full rental day being charged for each day or portion thereof.

If a chase boat is dispatched to locate you or retrieve abandoned equipment, a $40 retrieval fee will be charged in addition to any applicable rental fees.

A $10 cancellation fee applies if a reservation is canceled within 24 hours of the scheduled rental.

A $20 cancellation fee applies if a reservation is canceled within 1 hour of the scheduled rental.

You are responsible for equipment that is lost, stolen, or damaged beyond normal wear and tear during your reservation.

Charges for repair or replacement will be based on the reasonable cost to repair or replace the equipment, not to exceed the current retail replacement value of the item, plus tax and transport/shipping, when applicable.

Single Kayak – $275

CUSTOMER IS RESPONSIBLE FOR EQUIPMENT THAT IS LOST, STOLEN, OR DAMAGED BEYOND NORMAL WEAR AND TEAR DURING THE RENTAL PERIOD.
PAYMENT FOR DAMAGE OR LOSS
If rental equipment is returned damaged beyond normal wear and tear, or if any equipment is lost or stolen during the rental period, BearFoot Kayak LLC will assess the reasonable cost of repair or replacement. The renter agrees to pay all applicable repair or replacement costs within ten (10) days of receiving an invoice. If a credit or debit card has been voluntarily provided and authorized for an off-site or multi-day rental, the renter authorizes BearFoot Kayak LLC to
charge only those documented amounts permitted under this Rental Agreement. Copies of repair estimates, invoices, or other documentation will be provided upon request.
BY PROCEEDING WITH THE RENTAL, THE CUSTOMER ACKNOWLEDGES THAT THE EQUIPMENT HAS BEEN INSPECTED, OR THAT THEY HAVE HAD THE OPPORTUNITY TO INSPECT IT, AND ACCEPTS IT AS BEING IN GOOD WORKING CONDITION UNLESS EXISTING DAMAGE IS DOCUMENTED BEFORE THE RENTAL BEGINS.

Photo & Video Permission (Optional)
BearFoot Kayak LLC occasionally photographs or records participants and equipment during rentals for promotional purposes,
including social media, the company website, printed materials, and other marketing. Your choice below is voluntary and will not
affect your rental.
☐ YES – I grant BearFoot Kayak LLC permission to photograph and/or record me and to use my image, likeness, and voice for
promotional and marketing purposes without compensation.
☐ NO – I do not grant BearFoot Kayak LLC permission to photograph or record me for promotional or marketing purposes.
